You will be working as Contracts and Claims Manager and will be part of Process Automation business for Process Industries division based in Bangalore, India. In this role you will be reporting to Business Controller and will be responsible for leading the provision of contract management services, ensuring all contract management activities are executed in accordance with the relevant group / division / business directives and instructions including company procedures and the contract management framework. Your responsibilities Ensures that the portfolio of contracts in the business follows contract and claim management methodologies in accordance with internal standard procedures. Reviews and comments on commercial and technical tender terms and conditions. Develops contract strategy based on ABB’s policies, customer requirements, and the overall execution strategy, considering the risk, pricing, scope, and schedule. Identifies the contract baseline (including terms and conditions, specifications, drawings, estimate, proposal, schedule, and other documents incorporated in the contract) and highlights the areas of potential risk. Ensures timely and accurate execution of commercial aspects in the portfolio of contracts (i.e., payments, claims, variation orders, warranties, provisions, guarantees, etc.). Verifies that both parties to the contract have fulfilled their contractual obligations and are free of any outstanding responsibilities. Assesses the success of the contract and determines if there are any lessons learned for future contracting. Documents and communicates to all appropriate parties about any deficiencies found as part of the closeout process. Establishes and enforces standard change methodologies in the portfolio of contracts to identify changes and quantify the additional time and compensation due for ABB as per the contract, defines approval requirements, and communicates changes to the customer. Enforces and defends ABB's contractual interests against customers and suppliers throughout the project lifecycle, including monitoring and assessment of changes and deviations, as well as defending and enforcing claims. Develops the negotiation strategy, in concert with the Legal team, and supports in contract negotiations. Supports the Legal team in handling formal dispute resolution, litigation, and arbitration. Notifies and liaises with the Legal team to report major claims and keeps them updated of any critical development during project execution. Supports in drafting of purchase orders, contracts, and subcontracts, and ensures that relevant (sub) contracts contain appropriate contract terms to protect ABB’s interest, including flow-down of main contract terms. Analyzes the contract terms to highlight the areas of potential opportunity and risk, such as ambiguities, omissions, and conflicts, throughout the course of work. Seeks advice from the Legal team to draft, negotiate, and finalize agreements during sales and project execution phases. Develops and implements risk mitigation and opportunity plan, in concert with the Project Operations Manager and Business Line Manager Ensures contract insurance provisions are adhered to and coordinates with Insurance Risk Management team regarding occurrences that may be covered by customer or ABB provided insurance. Your background University degree in engineering, business administration, law, or similar Require more than 10 years’ experience related to project contracts Proven track record of handling projects of varying sizes and complexity in India Extensive experience in drafting contracts and conducting high-level negotiations, underpinned by the ability to oversee major claims, handle change management and resolve disputes. Excellent understanding of project planning / program analysis as well as business acumen, integrity, a results-oriented approach and finely honed problem-solving skills Solid presentation / communication skills together with excellent leadership and interpersonal skills as well as cultural awareness and the ability to engage with customers at all levels A collaborative, solution-focused approach and strong written and spoken communication skills
